Former Attorney General of the Federation (AGF), Abubakar Malami, remains in the custody of the Economic and Financial Crimes Commission (EFCC) despite being granted bail by an Abuja High Court, his media aide has said.
In a statement issued on Wednesday, Bello Doka, Malami’s media aide, described the continued detention as illegal and a violation of due process, noting that the bail order was granted on December 23, 2025.
Doka alleged that Malami had voluntarily submitted himself to the EFCC for investigation and had fulfilled all bail conditions imposed by the commission, yet remained in detention.
According to him, the EFCC’s action amounts to a breach of legal procedures and an abuse of office, stressing that the commission is obligated to respect and obey court orders.
“His continued detention in an EFCC facility constitutes a breach of legal procedures and a blatant abuse of office by an institution expected to uphold the rule of law,” Doka said.
He warned that disregarding a valid court order places the anti-graft agency in a position of acting above the law, adding that no individual or institution is above the law in Nigeria.
Doka further described Malami’s continued detention as an infringement of his fundamental human rights and cautioned that disobedience of court orders by a constitutionally established body could undermine democracy and public confidence in the justice system.
He also alleged that EFCC officials refused to accept the court order served by a bailiff and accused the commission of engaging in what he described as a “media trial” by promoting misleading narratives about the former AGF.
The aide challenged the EFCC to either arraign Malami before a competent court or comply fully with the court’s bail order, urging the commission to halt what he termed the spread of false and prejudicial information.
As of the time of filing this report, the EFCC had not publicly responded to the allegations.
