The Federal High Court in Abuja has dismissed a lawsuit challenging the emergence of former Attorney General of the Federation, Abubakar Malami (SAN), as the African Democratic Congress (ADC) governorship candidate for Kebbi State.
Delivering judgment on Tuesday, Justice M. G. Umar ruled that the plaintiff, Abdulrazak Isa Iko, failed to establish that he participated in the party’s governorship primary election. The court held that, having not taken part in the primary, the plaintiff lacked the legal standing to challenge its outcome.
Justice Umar consequently dismissed the suit in its entirety, describing it as lacking merit and substance.
The ruling effectively upholds Malami’s candidacy and removes a significant legal hurdle ahead of the governorship election, allowing the ADC candidate to concentrate on his campaign.
The court also reaffirmed the long-established legal principle that only individuals with the requisite legal standing can competently challenge the conduct or outcome of a political party’s primary election.
