The Trump administration is defending its decision to lock three major news outlets out of parts of the White House, telling a federal court that press access to the building is “a privilege — not a right.”
In a filing submitted Tuesday, the Department of Justice argued that President Trump has the authority to restrict journalists from areas such as the Oval Office, setting up a high-stakes First Amendment fight just one day before a scheduled court hearing.
The Ban
Trump ordered Friday that CNN, MS NOW and Politico be barred from the White House, accusing the outlets of publishing “fake news.” By Saturday, reporters from all three organizations had been denied entry to the White House grounds entirely, with their press credentials confiscated.
The outlets fired back with a lawsuit, calling the move “a direct assault on the First Amendment” and asking a judge for a temporary restraining order to block it. A hearing before a U.S. district judge is set for Wednesday.
DOJ’s Defense
According to the government’s court filing, the White House sent letters to each outlet Tuesday laying out the president’s reasoning, and gave them until Friday to respond. The letters reportedly point to a string of “reporting incidents” the administration says compromised national security or spread false information.
CNN’s letter specifically cited the network’s coverage of a planned bunker beneath the East Wing ballroom Trump is building, which the administration claims exposed sensitive construction details, along with several of the network’s stories on the Iran war.
Trump Doubles Down
The dispute isn’t confined to the White House gates. Speaking to reporters this week at the United Nations General Assembly, Trump seemed to suggest CNN shouldn’t be covering him anywhere.
“I’m surprised that CNN is here covering me, you shouldn’t be here,” he said.
The move fits a long pattern for Trump, who has repeatedly branded critical media coverage the “enemy of the people” throughout his campaigns and time in office.
The Bigger Picture
The timing is notable: the ban arrives as Trump’s approval ratings sit at record lows, Republicans face the possibility of losing Congress in November’s midterms, and the conflict in the Middle East continues without resolution.
