AGF arraigns 47-year-old man for  stealing railway track slippers worth N10m 

The Office of the  Attorney General Federation has arraigned a 47-year-old man,  Adeniji Richard on a four count charge  of unlawful destruction of Railway Track Slippers and stealing of railway irons worth N10 million.

This is as the presiding Judge, Justice Abimbola Awogboro has ordered the remand of the accuse in the custody of the Ikoyi Correctional Service till September 27, 2021 when his trial would commence.

According to the four count in charge, Adeniji Richard was alleged to have on the 21st of November, 2019 at about 3:27 am at railway line, Bolade Oshodi, Lagos State within the jurisdiction of the Federal High Court, did vandalize and stole Railway Track Slippers and Railway lrons valued at N10,000,000, property of the  Nigerian Railway Corporation and thereby committed an offence contrary to section 383 of the Criminal Code Act, Cap 77, Laws of the Federation of Nigeria, 2004 and punishable under section 390 (a) of the same Act.

When the arraignment of the accused came up today,  the prosecuting counsel, Kehinde Bode-Ayeni told the presiding Judge Awogboro that the prosecution has a four count charge before the court and pleaded that the charge be read to the defendant so that he can take his plea.

Following the reading of the charge and the defendant plea of not guilty, Bode- Ayeni asked the court for a trial date and the remand of the defendant in the custody of the Nigeria Correctional Services.

In her own submission, the defense counsel, F.D Bakenne-Salami seek for a short adjournment so that she can file a bail application on behalf of the defendant.

However, Justice Awogboro in her short ruling held that the defendant be remanded in Ikoyi  Prison while adjourning the matter till 27th and 28th of September for trial .

The charges against the defendant reads:

COUNT 1

That you, Adeniji Richard, ‘m’, aged 47 on the 21st day of November, 2019 at about 03:27 hrs at Railway line Bolade Oshodi, Lagos State, within the jurisdiction of the Federal High Court, did commit a felony, to wit: unlawful destruction of Railway Track Slippers and Railway Irons, public property belonging to the Nigeria Railway Corporation and thereby committed an offence contrary to section 3 (6) of the Miscellaneous Offences Act, Cap M17, Laws of the Federation of Nigeria, 2004 and punishable under section 1 (10) of the same Act.

COUNT 2

That you, Adeniji Richard, ‘m’, aged 47 on the 21st day of November, 2019 at about 03:27 hrs at Railway line Bolade Oshodi, Lagos State, within the jurisdiction of the Federal High Court, unlawfully destroy Railway Track Slippers and Railway lrons, public property belonging to the Nigeria Railway Corporation and thereby committed an offence contrary to section 1 (3) of the Miscellaneous Offences Act, Cap M17, Laws of the Federation of Nigeria, 2004 and punishable under section 1 (10) of the same Act.

COUNT 3

That you, Adeniji Richard, ‘m’, aged 47 on the 21st day of November, 2019 at about 03:27 hrs at Railway line Bolade Oshodi, Lagos State, within the jurisdiction of the Federal High Court, did vandalize and steal Railway Track Slippers and Railway lrons valued at N10,000,000 (Ten Million Naira), property of Nigerian Railway Corporation and thereby committed an offence contrary to section 383 of the Criminal Code Act, Cap 77, Laws of the Federation of Nigeria, 2004 and punishable under section 390 (a) of the same Act.

COUNT 4

That you, Adeniji Richard, ‘m’, aged 47 on the 21stday of November, 2019 a about 03:27 hrs at Railway line Bolade Oshodi, Lagos State within the jurisdiction of the Federal High Court, did attempt to steal damaged Railway Track Slippers and Railway Irons valued at N10,000,000 (Ten Million Naira) property belonging to the Nigerian Railway Corporation and thereby committed an offence contrary to and punishable under section 509 of the Criminal Code Act Cap 77 Laws of the Federation of Nigeria, 2004.
