Court Order on Fubara’s Impeachment a ‘Blatant Violation of the Constitution’ — Lawyer

A legal practitioner, Godspower Egbule, has faulted the court order issued on the impeachment process of Rivers State Governor, Siminalayi Fubara, describing it as a clear and flagrant disobedience of the Nigerian Constitution.

Egbule made this assertion on Monday while speaking during an interview on ARISE Television’s Morning Show, monitored by DAILY POST.

According to him, the Rivers State House of Assembly has acted within the confines of the law in initiating the impeachment proceedings against the governor, stressing that resorting to the courts at this stage is premature.

He argued that the development undermines the principles of constitutional democracy, particularly the doctrine of separation of powers.

“Ours is a constitutional democracy, and within that framework, we operate a system of separation of powers,” Egbule said. “The essence of this is to ensure checks and balances among the arms of government.”

He explained that the current actions of the Rivers State House of Assembly fall squarely within its constitutional role of checking the excesses of the executive arm.

Egbule further cited Section 1 of the Constitution, which establishes its supremacy and binding authority over all persons and institutions, insisting that any action inconsistent with its provisions amounts to a violation of the law.

“The Constitution is supreme, and its provisions must be respected by all authorities,” he added. “Any court order that interferes with a constitutionally guided process raises serious legal and democratic concerns.”

The impeachment process in Rivers State has continued to generate intense political and legal debate, with stakeholders divided over the role of the judiciary and the legislature in the unfolding crisis.
