President Bola Tinubu, Attorney-General Lateef Fagbemi, and Senate President Godswill Akpabio have been dragged before the Federal High Court in Abuja over the purported removal of Justice Danladi Umar as Chairman of the Code of Conduct Tribunal (CCT).
The lawsuit, filed by two civil society organizations and a lawyer, seeks to halt the implementation of a resolution by the Senate and House of Representatives that removed Umar from office. The plaintiffs argue that the removal contravenes the 1999 Constitution and established legal procedures.
Filed as suit number FHC/ABJ/CS/1796/2024, the plaintiffs are requesting seven key declarations and orders, including:
A declaration that the removal of Umar is unconstitutional, illegal, and void.
An injunction to restrain the Clerk of the National Assembly from transmitting the resolution to the President.
An order stopping any appointment to replace Umar during his subsisting term.
Justice James Omotosho has directed that court processes be served by substituted means at designated locations, including the APC secretariat and the Office of the Secretary to the Government of the Federation.
The case is set for hearing on January 14, 2025.
