In the latest twist to the internal discord within the Ondo State chapter of the All Progressives Congress (APC), Senator Jimoh Ibrahim has taken legal action by filing a suit at the Abuja division of the Federal High Court. Senator Ibrahim seeks to nullify the nomination of Governor Lucky Aiyedatiwa as the party’s candidate for the forthcoming November gubernatorial election.
Justice Iyang Ekwo has granted Senator Ibrahim’s request for substituted service of court processes on Governor Aiyedatiwa, alongside the APC and the Independent National Electoral Commission (INEC), who are co-defendants in the suit.
Representing Ondo South in the Senate, Senator Ibrahim alleges irregularities in the April 20 primary election that led to Governor Aiyedatiwa’s nomination. Through his counsel, Senior Advocate of Nigeria Chris Uche, Senator Ibrahim contends that certain provisions of the Constitution and the Electoral Act were violated during the primary election process.
Senator Ibrahim is seeking the court’s intervention to invalidate Governor Aiyedatiwa’s nomination, prevent INEC from recognizing him as the APC candidate, and halt Aiyedatiwa from presenting himself as such.
Furthermore, Senator Ibrahim is requesting the court to annul the primary election and compel the APC to conduct a fresh one in accordance with constitutional and electoral provisions.
During Wednesday’s proceedings, Senator Ibrahim’s legal team secured an order for substituted service of court processes on Governor Aiyedatiwa through the APC’s National Secretariat in Abuja.
Justice Ekwo has scheduled the hearing for May 14 to further deliberate on the matter.
